2210 Development Review

2210-01 Land Use Review (LUR) Records    

Series is created to document the applications and decisions in land use cases which require special review.  Records include application, site plans, zoning maps, notifications, reports, final decisions, supporting documents, responses from citizens, interpretations, etc.  If the case has been appealed to Council the record may include appeal and report to Council, Hearings records, Council Documents and acceptance.  Examples of Land Use Review records include Adjustments (ADJ), Alternative Design Adjustments (ADA), Convenience Store Review (CSR), Conditional Use (CU), Design Review (DZ), Greenway Permits, Minor Partitions (MP), Planned Unit Development (PUD), Site Review (SRZ), Historic Landmark Review (HLDZ), Subdivisions (S), Superblock Review (SB), Variance Records (VZ), Zone Changes, Plan Amendments, Revocable Permits, etc.

Retention: Permanent; Retain audio or visual recordings 1 year after minutes prepared and approved.

2210-02 Land Use Slides

Series is created to provide photographic evidence for land use case during public hearings.  Series is used to provide orientation and a view of property.  Records include slides and photographs taken of properties subject to the review process. Review slides and incorporate appropriate examples into Land Use Review Records (2210-01).

Retention: 5 years.  Destruction of slides and photographs is subject to archival review.

2210-03 Land Use Review (LUR) Log Records

Series is created to track Land Use Review (LUR) cases and to assign the next appropriate case number.  Series is used as a reference to information found in LUR records.  Log generally consists of file number, file date, quarter section number, applicant, zone proposal, type of review, action, appeal date, result, ordinance number and acceptance.

Retention: Permanent.  Print out log/database on an annual basis.

2210-04 Development Review Log Books and Indexes

Series is created to track applications and land use reviews.  Series is used as a reference to identify land use cases.  Record consists of application number, date, state ID number, applicant’s name, zone, proposal, legal description, type of review, action, appeal date and results, ordinance number, acceptance, tax account number, and other related information.

Retention: 10 years after superseded or abolished, subject to archival review.

2210-05 Review Boards and Commission Records

Series is used to document the discussions and actions of various review committees.  The review committees are created to review specific planning concerns and to set or review standards.  Records include summary minutes, agendas, background material and other records.  Examples include Design Commission, Historical Landmarks Commission, Variance Committee, Adjustment Committee, etc.

Retention: Retain minutes, agendas, resolutions, indexes, and exhibits (not retained permanently elsewhere in city records) permanently; Retain audio or visual recordings 1 year after minutes prepared and approved.  Retain other records and exhibits not pertinent to minutes 5 years).

2210-06 Historic Landmark Records

Series created to gather information on individual landmarks and historic districts. Series is used to document historic landmarks according to Code 33.120.  Records include landmark requests, acceptances, denials, and possible additional landmark sites.  Records include historic districts, National Register properties, state and local historic records.

2210-07 Pre-Application Conference Records

Series is used to provide information about proposals and notes of information given during pre-application conference.  Notes are required by City Code. Records consist of plans and written materials submitted by applicant, bureau and other interested parties.  Information may be transferred to case file if formal application is filed.

Retention: If application is filed, transfer to 2210-01; if application is not filed, retain 180 days.

2210-08 Cellular Facilities Records

Series is created to track the location and type of cellular facilities owned by private companies within the city limits.  Series is used to encourage co-location of cell sites.  Records include company name, type of facility, frequency, antenna/tower height, zoning information, address, quarter section, capacity, co-locatability, etc. 

Retention: Until superseded or obsolete

2210-09 Zoning Determination Records

Research, analysis, and determinations related to whether proposed building/land use activity conforms to existing Zoning Code.  Records include, but are not limited to: zoning confirmation letters; nonconforming use determinations; land use review histories; development analyses; lot confirmations; and property line adjustments.
