Building Permit Plan Review & Pre-issuance Service Level Updates

To address the increased workload the Bureau of Development Services, and its development review agencies partners, are in the process of creating new positions and hiring employees.

CUSTOMER & COMMUNITY NOTIFICATION

Year over year growth in the construction industry has outpaced the City’s ability to keep up with related workload and meet several of its turn-around timeline goals. To address the increased workload the Bureau of Development Services, and its development review agencies partners, are in the process of creating new positions and hiring employees. We appreciate your patience as we bring on new employees and apologize for inconveniences caused by the changes to turn-around timelines. 
 
Over the next 6-9 months, as we work on filling vacancies and training staff, applicants can expect the following changes to building permit plan review and pre-issuance timelines: 

  • Receiving plan review comments (first checksheet) from City review groups for new commercial building permits varies, but has been averaging no later than 35 working days. Our goal is 20 working days. 
  • Receiving plan review comments for new one & two family residential building permits, varies, but has been averaging no later than 25 working days. Our goal is 15 working days. 
  • Pre-issuance (the last mandatory review process) of building permits is currently taking an average of 9-10 working days. Our goal is 2 working days. 
  • Most residential remodels, additions and simple permits continue to be issued in one-day over the counter, although we have been experiencing extended wait times in the Development Services Center. 

Please take these timeline changes into consideration as you prepare your project’s permitting schedule.
 
Complete Applications Can Reduce Review Timelines
The submittal of complete and code compliant building permit applications can help reduce review timelines for individual projects. We strongly encourage applicants to review the minimum submittal requirements outlined in the Commercial New Construction and Additions – Applying for My Permit webpage and/or the Residential Permits webpage. In addition, a new Commercial Life Safety – Completeness Checklist is now available and will help applicants and staff ensure a complete and code compliant application is ready for review.

The Bureau of Development Services is providing notification of an opportunity to comment on a proposed deconstruction requirement being brought forth by the Bureau of Planning and Sustainability.

deconstruction workersDeconstruction is a method for removing structures that keeps valuable materials out of the landfill, protects health, creates pathways to construction careers and generates affordable reusable building materials. Draft code language for Portland’s new deconstruction requirement will help shape how certain buildings are removed in Portland. Currently, less than 10 percent of houses that are removed use deconstruction -- the rest are mechanically demolished, sending most materials to the landfill.

BPS is accepting public comment through May 18, 2016 on the proposed code. For detailed information on why the deconstruction amendment was proposed, next steps, benefits to deconstruction, and an overview of the code language being developed visit http://www.portlandoregon.gov/bps/article/573891.

Waiver of System Development Charges (SDC) for Accessory Dwelling Units (ADU) Extended until July 2018

On April 13, 2016 City Council unanimously passed a Resolution extending the current waiver of System Development Charges for Accessory Dwelling Units.

Accessory Dwelling Unit (ADU)

On April 13, 2016 City Council unanimously passed a Resolution extending the current waiver of System Development Charges for Accessory Dwelling Units. The Resolution directed all affected Bureaus to extend the current waiver of SDCs for new ADUs or the conversion of structures to ADU units until July 31, 2018, provided that the ADU is constructed and receives final inspection and certificate of occupancy by June 30, 2019.  This extension is to encourage homeowners and contractors to continue the building of ADUs which are integral to the achievement of the City’s affordable housing and housing density goals.

The affected bureaus are Water, Parks and Recreation, Environmental Services and Transportation. Please note that the Bureau of Development Services is responsible for the development review process, but does not assess SDC fees. All other non-SDC development related fees for ADU development are due prior to permit issuance. Questions about SDC’s should be directed to the individual Bureaus. Accessory Dwelling Units (ADU) are defined by the Portland Zoning code as a second dwelling unit created on a lot with a house, attached house or manufactured home. The second unit is created auxiliary to, and is smaller than, the house, attached house (rowhouse) or manufactured house.

Amendments to Title 11, Trees, Tree Preservation in Development Situations, Become Effective May 13, 2016

The amendments strengthen regulations for tree preservation in development situations on private property.

Due to recent public concern about large trees being removed in development situations in Portland neighborhoods, amendments to Title 11, Trees, were developed to strengthen regulations pertaining to tree preservation, especially preservation of large sized trees, in development situations on private property. The project began in November 2015 and was jointly staffed by the Bureau of Parks and Recreation-Urban Forestry and the Bureau of Development Services, the two bureaus responsible for implementing Title 11.

On April 13, 2016 City Council approved the amendments to Title 11, Trees. The amendments become effective on May 13, 2016.

The amendments to Title 11 are summarized as follows:

  1. Continue to require that at least 1/3 of non-exempt trees must be preserved or pay a fee in-lieu of preservation, regardless of tree size. Now require that all non-exempt trees with a diameter of 36 inches or larger be preserved or pay a fee in-lieu of preservation.

  2. Amend the fee in-lieu of preservation as follows:
    • For removal of non-exempt trees with a diameter of 12 inches or larger, but less than 36 inches, a graduated scale is used to determine the payment amount. Based on the current fee schedule, the fees are $1,200-$2,400 per tree removed.
    • For removal of non-exempt trees with a diameter of 36 inches or larger, an “inch-per-inch mitigation” payment is required. Based on the current fee schedule, fees start at $10,800 for removal of a 36-inch diameter tree and increase at $300 per additional diameter inch of tree removed.
  3. Require applicants to post a notice on-site and send a notice to the neighborhood association and district coalition 45 days prior to development permit issuance for removal of non-exempt trees with a diameter of 36 inches or larger.

  4. Certain affordable housing projects, as defined by the Portland Housing Bureau, are exempt from the fee in-lieu of preservation for removal of non-exempt trees with a diameter of 36 inches or larger.

  5. A sunset date of December 31, 2019 is included.

The following new forms relate to the notification requirement for removal of non-exempt trees 36 inches or greater in diameter. Applicants will be required to submit a certification form verifying notification requirements have been met. This certification must be submitted prior to development permit issuance.

  1. On-site posted notice
  2. Suggested language for e-mailed or mailed notice to neighborhood association and district coalition.
  3. Self certification verifying notification requirements are met

The Bureau of Development Services wants to share the following information with our customers and the community about upcoming revisions to the Stormwater Management Manual being processed by the Bureau of Environmental Services. 

The federal Clean Water Act and the Safe Drinking Water Act require Portland to implement post-construction stormwater management for both private property and the public right-of-way. Portland developed its Stormwater Management Manual (SWMM) in 1999 and is currently updating the SWMM.

BES will accept public comment on the proposed SWMM revisions from 8:00 a.m. April 4, 2016 through 5:00 p.m. May 6, 2016. The proposed SWMM changes will be posted for review at www.portlandoregon.gov/bes/70389. Public comments may also be submitted online, by mail, or by email.

If a public hearing on the proposed SWMM changes is requested, the city will hold a hearing on Wednesday, April 20 at 5:30 p.m. at 1900 SW 4th Avenue in Room 2500B. If the city does not receive a request to hold a public hearing by 5:00 p.m. on April 18, the hearing will be cancelled.
