Zoning Code Amendment Proposed to Extend Land Use Review Expiration Period

In recognition of the continuing economic climate and how it is adversely impacting developers and homeowners, the Bureau of Development Services and the Bureau of Planning and Sustainability are proposing a Zoning Code amendment that would extend Zoning Code Amendmentthe expiration date of approved land use reviews. The Planning and Sustainability Commission will consider the amendment at a hearing to be held on April 10, 2012, at 1900 SW 4th Avenue, Suite 2500A. The Planning and Sustainability Commission meetings begin at 12:30 pm. Please call 503-823-7700 after April 3, 2012 for the exact time this item will be on the agenda. If the proposal receives a favorable recommendation from the Planning and Sustainability Commission, City Council will consider the amendment in late May 2012.

Generally, an approved land use review expires if a building permit is not issued within three years of the land use decision. In 2009, City Council extended the time in which a building permit must be received for a subset of land use review approvals. For land use reviews that were approved between May 27, 2006 and December 31, 2008, the extension allowed applicants until June 30, 2012 to receive a building permit. Under the proposed amendment, for land use reviews that were approved between May 27, 2006 and June 30, 2011, applicants would have until June 30, 2014 to receive a building permit.

Preliminary plan approvals for land divisions generally expire unless an application for final plat is submitted within three years of the land use decision. For preliminary plans that were approved between May 27, 2006 and December 31, 2008, the 2009 City Council extension allowed applicants until June 30, 2012 to submit a final plat application. For preliminary plans that were approved between May 27, 2006 and June 30, 2011, the proposed extension would allow applicants to submit a final plat application by June 30, 2014.
