Update on SE Division and 37th Avenue Development

On Tuesday, April 30, 2013, the new building permit (No. 13-137610 CO) was issued, the Stop Work Order was lifted and the old permit (No. 12-136565 CO) was cancelled. Work on the project can resume.

On Tuesday, April 9, 2013, the applicants submitted a new building permit application for the project at 3701 SE Division Street. The building permit application contains all of the necessary information required by the city code and by BDS and is complete. Reviewing BDS departments and interagency partners have been assigned and plan review has begun. When it is found that all applicable regulations are satisfied and fees are paid, the permit will be issued, the Stop Work Order (for Permit No. 12-136565 CO) will be lifted and work may resume on the project.

The review of the revision to Building Permit No. 12-136565 CO was suspended on March 21, 2013. The Stop Work Order remains in effect. A new building permit application is required.

 


 

Update Date and Time - March 19, 2013 - 4:30 PM


On August 14, 2012, the city issued a building permit for an 81-unit apartment building at 2450 SE 37th Avenue.

On December 19, 2012, Richmond neighbors filed an appeal with the Land Use Board of Appeals, or LUBA. The appeal focused on four issues:

  • The building height
  • Transportation impacts
  • Whether the City must provide notice and a hearing on the building permit
  • The building's main entrance

On February 20, 2013, LUBA issued its ruling. It rejected the first three of the arguments and upheld the one regarding the building's main entrance. That ruling reversed the City of Portland’s decision to approve a building permit for the project. The LUBA ruling had a 21-day appeal period.

On February 25, 2013, in response to LUBA's decision, the Portland Bureau of Development Services (BDS), issued a stop-work order.

According to the City Attorney and BDS, the applicant could either revise their existing permit after any appeal periods expired or apply for a new permit after holding a neighborhood meeting with a required 45-day notice.

The deadline for appealing LUBA's decision to the Oregon Court of Appeals has now expired and no appeal has been filed.

On March 19, 2013, the applicant filed revisions to the existing Building Permit No. 12-136565 CO. The revised plans eliminate proposed retail space and replace it with non-commercial common areas to serve the project’s apartment residents.

The revisions have been taken in for review. The Stop Work Order on construction at the site will remain in place while the revised plans are under review.

On March 13, 2013, BDS verified that the project has been temporarily weatherized and secured as per the March 1, 2013 proposal. Work on the installation of the building’s fire sprinklers will continue over the next several weeks as directed by Portland Fire & Rescue.



Update Date and Time - March 5, 2013 - 3:40 PM

On Friday March 1, 2013, BDS reviewed and accepted a proposal by the contractor to perform specific work relative to the weather protection of the exposed structure and safety of the project site and surrounding area while the Stop Work Order remains in effect, including installation of 3rd floor joists and deck at south portion of building to facilitate installation of temporary horizontal weather barrier, installation of temporary weather barrier at upper roof area, installation of temporary gutters to direct storm water runoff, installation of weather barrier membrane at exterior wood walls, and general site clean up. The installation of fire sprinklers within the structure, as requested by Portland Fire & Rescue to minimize risk of fire to the exposed structure and adjacent properties, will extend beyond this timeline. This work is proposed to be substantially completed during the week of March 4, 2013. Building Permit (12-136565 CO) was issued August 14, 2012 for a mixed use project proposed for the corner lot at SE Division and 37th Ave (2450 SE 37th Ave). On December 19, 2012 the building permit was appealed with the Land Use Board of Appeals (LUBA) on a number of issues.

On February 20, 2013, LUBA released its decision reversing permit approval because it did not comply with an applicable main entrance building requirements in the Zoning Code. There is a 21-day period to appeal LUBA's decision to the Oregon Court of Appeals and March 13, 2013 is the last day to appeal.

BDS issued a Stop Work Order on Monday February 25, 2013, requiring cessation of all construction activities.

This work is proposed to be substantially completed during the week of March 4, 2013. Installation of fire sprinklers within the structure will extend beyond this timeline, as requested by Portland Fire Bureau, to minimize risk of fire to the exposed structure and adjacent properties.

The property owner ceased construction activity on February 22nd as required and requested by BDS. On February 25th, BDS will issue a Stop-Work order and is working with the property owner’s representative on a plan to immediately secure and “button up” the construction site, to assure all safety concerns are addressed properly while the Stop-Work order is in effect.

This is a mixed use project proposed for the corner lot at SE Division and 37th Ave (3701 SE Division). The Building Permit was issued August 14, 2012, and construction begun.

The Building Permit (12-136565 CO) was appealed to Oregon's Land Use Board of Appeals (LUBA) on a number of issues.

LUBA's decision was released Feb. 21st, reversing the decision on the Building Permit based on one of the appeal issues related to the main entrance building requirements in the Zoning Code.

There is a 21-day appeal period for LUBA's decision, making March 14, 2013 the last day to appeal this decision.

Currently, the bureau is reviewing issues around ongoing construction to determine the best course of action moving forward.
