Substantive Changes:

  • Chapter 33.110: In the single-dwelling zones, revise code on measuring lot width, regulating duplexes/attached houses on corner lots, development on flag lots and length of garage wall.
  • Chapter 33.248 & 33.630: Require chain link fencing around trees to be preserved during development and land divisions.
  • Chapter 33.251: Revise Manufactured Home and Dwelling Park Chapter to comply with regulations in state law, including the minimum number of units that trigger the special manufactured dwelling park regulations.
  • Chapters 33.140 & 33.515: Reduce the maximum size of Retail Sales And Service Uses that are allowed through a Conditional Use Review, in conformance with Metro regulations.
  • Chapter 33.526: Revise the open area requirement in the Gateway plan district.
  • Chapter 33.530: Clarify flag lot standards in the Glendoveer plan district including dimensions, setbacks and the maximum height of structures.
  • Chapter 33.610 & 33.611: Revise the standards that apply to the land division of new narrow lots and flag lots in the RF through R2.5 zones.
  • Chapter 33.612: Increase the required minimum lot width for attached and detached house lots in the R3, R2, and R1 zones.
  • Chapter 33.654: Amend land division regulations related to the provision of alleys.
  • Chapter 33.665: Amend the approval criteria for Planned Developments.
  • Chapter 33.810: Create additional restrictions and approval criteria that apply to quasi-judicial requests to amend the Comprehensive Plan Map designations of industrial and employment lands. This is done to bring the city’s industrial policy in compliance with Metro’s policies.
  • Chapter 33.815: Add new approval criteria for conditional uses in industrial zones to address truck and freight movement.
  • Chapter 33.910: Revise the definitions of Exterior Storage, Living Area, Corner Lot, Through Lot, and Manufactured Dwellings and Parks.
  • Chapter 33.920: Clarify the Daycare Use Category to exempt registered family childcare for care given to 16 or fewer children in compliance with state law.
  • Chapter 33.930: Revise the method of measuring lot width in single-dwelling zones.

Minor Changes:

  • The remainder of code changes are generally of a technical nature intended to clarify the Zoning Code and make it easier to understand and implement.
