This Code Update is the result of the Regulatory Improvement Code Amendment Package 7 (Ordinance 187216) and the Multnomah County Health Department Headquarters project (Ordinance 187217).

Substantive changes

This package includes more than 40 zoning code amendments addressing over 90 sections of code. These amendments are part of the Regulatory Improvement Code Amendment Package 7 (RICAP 7). For more about RICAP and a complete description of the amendments contained in RICAP 7, see the Regulatory Improvement webpage. This package also includes one amendment to the height map in the Central City Plan District.

Highlights of RICAP 7 include amendments

  1. Created a provision to allow for minor revisions to approved Type III design reviews through a Type II review process. Converted the other design review thresholds from a list to a table.

  2. Made preapplication meeting conferences (when required) a mandatory prerequisite before submitting a land use application.

  3. Clarified and corrected use of term “Floor Area”, by replacing with “Net Building Area” throughout the zoning code where the regulation pertained to amount of a land use. This more accurately accounts for area located below grade, and excludes structured parking area. Floor area continues to apply to situations pertaining to the mass and bulk of a building. Addressed how to measure the areas of limited uses, including eating areas and common spaces.

  4. Clarified measurement methodology for “shed roofs” to explicitly state that these roofs are measured to the highest point.

  5. Clarified that projections are not allowed in landscape buffers for sites in non-residential zones that abutted residential zones, except for building eaves.

  6. Established 1-year expiration for neighborhood contact.

  7. Reorganized definitions chapter and ungrouped “related” terms.

Highlights of the Multnomah County Health Department Headquarters project

  1. Revised Map 510-3 to modify the allowable height from 75’ to 105’ and enable the use of height bonuses.
