Upon written request from a building owner, the Bureau of Planning and Sustainability (BPS) may exempt a covered building for a specific year based on one or more of the following conditions:
- The building is new construction and energy service has not yet been established for a full calendar year;
- The building was wholly unoccupied during the entire calendar year for which reporting would otherwise be required;
- A demolition permit was issued for the building during the calendar year for which reporting would be required; or
- Due to a special circumstance unique to the building, compliance would cause undue hardship for the owner.
The exemption request must be received no later than March 31, 2016. Within 30 days of receiving the exemption request, BPS will provide a written response to acknowledge receipt of the request and determine whether the request is approved or denied.
