TEMPORARY SUSPENSION OF PARKS SYSTEM DEVELOPMENT CHARGES FOR QUALIFIED ACCESSORY DWELLING UNITS

PURPOSE

Section 1. The Council finds:

1.  On March 3, 2010, Council adopted Resolution No. 36766 to allow for suspension of systems development charges for Parks and Recreation, Environmental Services, Transportation, and Water for the construction of accessory dwelling units or the conversion of structures to accessory dwelling units until June 30, 2013.

2.  On December 5, 2012, Council adopted Resolution No. 36980 to extend the current suspension of systems development charges for Parks and Recreation, Environmental Services, Transportation, and Water for the construction of accessory dwelling units or the conversion of structures to accessory dwelling units until July 31, 2016.

3.  On April 13, 2016, Council adopted Resolution No. 37201 to extend the current suspension of systems development charges for Parks and Recreation, Environmental Services, Transportation, and Water for the construction of accessory dwelling units or the conversion of structures to accessory dwelling units until July 31, 2018.

4.  Resolution No. 37201 directed Portland Parks and Recreation to return to City Council with the changes necessary to implement this resolution by May 18, 2013.

5.  To comply with the suspension, it is necessary to amend the Residential Parks SDC Fee Rate Schedule to indicate the ADU fee suspension. The amended Parks SDC Fee Rate Schedule is attached as Exhibit A.


POLICY

NOW, THEREFORE, the Council directs:

a.  Amend Ordinance No. 186036 to extend the temporary suspension of Parks system development charge for qualified accessory dwelling units as shown on Exhibit A: “Amended Residential Parks SDC Fees.”

b.  This ordinance and exhibit are binding City policy.

Section 2. The Council declares that an emergency exists in order to comply with the Council directives of Resolution No. 37201, and eliminate barriers to the achievement of City density and affordable housing goals; therefore, this ordinance shall be in force and effect from and after its passage by the Council.
