POLICY (337.00) 

The Police Review Board (PRB) serves as an advisory body to the Chief of Police.  The PRB includes a Facilitator and citizen and peer members of the same rank as the Bureau member whose conduct is the subject of review.  Portland City Code 3.20.140 requires the Police Bureau and Independent Police Review to establish a directive outlining selection criteria and confidentiality provisions for PRB Facilitators.  

PROCEDURE

Appointment, Removal and Qualification of Board Members (336.00)

Citizen board members shall be appointed and removed as follows:

Citizens will be selected by City Council upon nomination by the City Auditor based on the following:

  • Absence of any real or perceived bias for or against the police or any real or perceived conflict of interest. 
  • Demonstrated ability to review complex investigations.
  • Demonstrated ability to make sound and rational decisions under pressure.
  • Residence or business ownership within the City of Portland.

The Chief may identify candidates for the City Auditor’s consideration.  

The City Auditor will identify qualified candidates to the Chief.  The Chief will have no more than 30 days to comment on the qualifications of the candidates before the City Auditor recommends them to City Council.   

The City Council will confirm citizen volunteers to form a pool of citizen members to serve on the PRB. 

Citizen members shall be appointed for a term of no more than three years.  Citizens may serve no more than two full terms, not including the remainder of any unexpired vacancy they are appointed to fill.  

The Chief or the City Auditor may recommend that City Council remove a citizen member from the pool for the following reasons:

  • Failure to attend training;
  • Failure to read Case Files; 
  • Disrespectful or unprofessional conduct;
  • Repeated unavailability for service when requested; or
  • Breach of confidentiality.
  • Demonstrated bias for or against the police.  
  • Demonstrated conflict of interest.  
  •  

Citizen board member qualifications:

1.   Citizen members must pass a background check performed by the Bureau.

2.   Citizen members must participate in Bureau training to become familiar with police training and policies, including the PRB process.

3.   Citizen members must sign a confidentiality agreement. 

4.   Citizen members will be required to participate in ride-alongs to maintain sufficient knowledge of police patrol procedures. 

Peer board members will be appointed and removed as follows:

 

  • Peer member applications will be reviewed by the Branch chiefs who will make recommendations to the Chief of Police.
  • The Chief of Police will appoint Bureau members to serve as peer members for the PRB.  
  • Representatives of the Bureau’s bargaining units may review the applications. 
  • All peer members will serve at the discretion of the Chief of Police.

Board Facilitator’s Selection and Qualifications (337.00)

The PRB will be facilitated by an independent contractor who is not a board member or employed by the Police Bureau and will be selected as follows:   

The Bureau will prepare a solicitation document in accordance with City contracting rules.  

The Bureau will provide the IPR director a draft of the solicitation document for comment.

The selection criteria will include:

 

  • Experience in the basic skills of following good meeting practices: timekeeping, following an agreed-upon agenda, and keeping a clear record.
  • Experience in watching groups and individuals and group dynamics.  
  • Demonstrated listening skills including ability to paraphrase and balance participation.  
  • Demonstrated ability to be a 'content neutral' party who by not taking sides or expressing or advocating a point of view during the PRB meeting can advocate for fair, open, and inclusive procedures.   
  • Demonstrated ability to contribute structure and process to interactions so groups are able to function effectively and make high-quality decisions. 
  • The Bureau will screen the responses to the solicitation.
  • A group of voting members appointed by the Review Board Coordinator (RBC) and including at least one citizen member, one peer member, the Professional Standards Captain, an RU manager, and the IPR director (or designee) will meet to review the screened responses and recommend to the Commissioner in Charge a pool of facilitators based on the selection criteria established in this Directive. 

 

Facilitators must: 

  • Pass a background check performed by the Bureau.
  • Participate in Bureau training to become familiar with the PRB process.
  • Sign a confidentiality agreement.
