Portland Police Traffic Investigators have identified 53-year-old Donald Burl Yarbour Jr. as the pedestrian killed in Sunday night's crash on Southeast 82nd Avenue near Kelly Street.

The driver who struck Yarbour, 32-year-old Joseph Spears, remained at the scene and cooperated fully with investigators. Spears was not impaired by alcohol and consented to a breath test, which showed a blood alcohol content (BAC) of .00.

Investigators determined that Yarbour, who was wearing all dark clothing, was crossing 82nd Avenue from East to West and not using a crosswalk. Investigators determined that Spears was driving at or below the speed limit of 35 MPH at the time of the crash.

It is not known if Yarbour was under the influence of drugs or alcohol at the time of the crash.

No charges will be filed in this case.



Tonight, Sunday, June 10, 2012 at 9:28 p.m. Portland Police officers assigned to East Precinct responded to a call of a pedestrian struck on 82nd Avenue near Powell Boulevard. Officers arrived on scene and located an adult male who was fatally injured from being struck.

The Traffic Division Major Crash Team was called to the scene to conduct the instigation. The driver of the car was traveling southbound on 82nd Avenue and remained at the scene. Speed and impairment were not factors in the crash.

Investigation is ongoing.
