On Monday, August 20, 2007, at 6:30 am, an East Precinct officer shot at 26-year-old Lesley Paul Scott Stewart after responding to a report of domestic violence with possible shots fired in the 12500 block of Southeast Stark Street. Officers were dispatched after a woman called 911 stating that Stewart was threatening to kill her. While the woman was talking to dispatchers, they heard what they believed were gunshots in the background. Officers arrived and were quickly able to establish phone contact with the occupants of the residence.
During the ongoing negotiations, officers talked to the highly agitated suspect who threatened to kill the two other occupants of the apartment. Officers also confirmed that the suspect had access to a handgun, had a documented history of violence, and was currently on parole for attempted murder. During the continuing negotiations officers convinced Stewart to allow the victims to leave the apartment. As additional officers arrived, they took up positions behind the apartment complex. The officers saw Stewart lean out of the window approximately 30 feet from their position. Officers repeatedly gave Stewart commands to raise his hands and surrender.
While detectives have not completed all interviews, from available witnesses it appears that Stewart was watching the officers as he made a movement towards a closet or cabinet. Shortly after making that movement, 36-year-old Officer Stephanie Rabey, a 12-year-member of the Police Bureau discharged a single shot from an AR-15 rifle. The shot struck the glass and frame of the window causing a small fragment of bullet, a piece of glass, or a small piece of the aluminum frame to strike Stewart in the head. Stewart fell to the ground and surrendered a short time later.
During the subsequent investigation, detectives located a handgun in a car associated with the suspect but did not locate a gun in the apartment. Detectives are continuing the investigation and expect to complete their interviews by Thursday, August 23, 2007.
