Suspect arrested in Kidnap / Sexual Assault

On Friday, September 2, 2005, at approximately 5 p.m., 28-year-old Heriberto Castro-Gutierrez was arrested by police officers in Woodland, California, on Kidnapping, Carjacking, Sexual Assault and Restraining Order Violation charges. Investigators in California believe that the crime began in Portland when Castro-Gutierrez hid in the van of the 27-year old victim, who is his estranged wife. At 7 a.m. that morning, the victim entered her van which was parked near her St. Johns home and began driving her 2-year-old child to daycare. While en route, Castro-Gutierrez jumped up from the back of the van and grabbed the victim. This caused the victim’s vehicle to come to an abrupt stop in the middle of North Interstate Avenue at North Emerson Street. Castro-Gutierrez overpowered the victim and drove her to a secluded area, restrained her, and then drove the victim and her child south on Interstate 5 to California. The victim was repeatedly sexually assaulted between Portland and California. The women alerted a clerk at a Woodland, California, gas station, telling her that she and her child had been kidnapped in Portland, and they needed help. The clerks called 9-1-1 and Castro-Gutierrez was arrested at the scene.

The victim’s van has been recovered. Castro-Gutierrez is in custody in Woodland, California. Portland Police Detectives are working in cooperation with California law enforcement authorities and will be presenting evidence in this case to the Multnomah County District Attorney’s Office.

Portland Police Detectives are looking for witnesses who may have seen Castro-Gutierrez conceal himself in the victims van, which was parked in the area of North Princeton Street and North Buchanan Avenue, anyone who may have seen the victim struggle with Castro-Gutierrez in the area of North Interstate Avenue and North Emerson Street, or anyone who may have seen the victim’s van in the area of North Concord Avenue and North Going Court that morning.
