The Office for Community Technology (OCT) administers and reviews requests for wireless carrier macro sites located within the public right-of-way (ROW), e.g., attachments on utility poles located near the road or sidewalk. ROW permits are administrative permits in public streets. ROW siting and administrative permits are not governed by the zoning code.
Carriers are required to follow a pre-application notification process for new macro sites proposed in certain residential areas. Wireless News: Final administrative rule UTL 3.08
The Office for Community Technology will be adopting administrative rule UTL 3.08 on Friday, October 11, 2019. Rules for macro wireless facilities in the right of way have been in place since 2009 through franchise agreements. The administrative rule address macro wireless facilities—wireless infrastructure in the right of way that exceeds the definition of a “small wireless facility.” The city codified the requirements into an interim administrative rule on April 15, 2019. OCT will be holding a public meeting on Thursday, September 19th, from 6:30 pm to 8:00 pm at the East Portland Community Center, 740 SE 106th, Portland, OR 97216, to discuss the rule with interested residents.
