Rule Change Regarding Return of Prohibited Contributions
After consultation with the Citizen Campaign Commission, the City Auditor has
amended City Administrative Rules ADM-2.10 and 2.11 related to the return of
prohibited contributions by candidates seeking certification to receive public
campaign financing. The rule change is effective December 16, 2005.
Previously City Administrative Rules required participating candidates to
return prohibited contributions within 5 business days in order to remain
eligible for public funding. Per City Code and Administrative Rules, prohibited
contributions include qualifying contributions exceeding $5, qualifying
contributions from non-residents, seed money contributions exceeding $100 or
seed money contributions exceeding the allowed aggregate limit of $20,000 for
Mayor candidates and $15,000 for Commissioner and Auditor candidates.
The five day timeline has proved impractical. Under the revised rules,
participating candidates must simply return all prohibited contributions prior
to filing a Request for Certification pursuant to the procedures in
Administrative Rule 2.11.
