Land Use Review Decision Recording Process

Land Use Review Decision Recording Process

Effective June 9, 2017 – The Land Use Services Division is changing the process for how approved land use reviews get recorded with Multnomah County. Instead of requiring applicants to record decisions after a land use review has been approved, land use services staff will be working directly with the county to record decisions. This includes paying for the cost of the recording. This costs ranges from $56 to over $100 per land use review. This will be a cost savings for applicants, save time from having to go to the county recorder office and eliminate a step that was required before applying for a construction permit. This change will also reduce staff time that was taken to reissue lost recording documents or to explain the confusing process to applicants new to the process.

Projects may or may not require a land use review depending on the zoning at the site, and the uses or developments that are proposed. Land use reviews are required when the zoning code "triggers" a review for a specific use or development project. Regulations directing a proposal to a land use review can be found in the base zones, overlay zones, plan districts, and other sections of the zoning code, as well as within conditions of approval from past land use approvals at the site. Most review "triggers" are located in the zoning code chapter addressing a particular topic.

Starting in June, the Bureau of Development (BDS) will offer reserved weekly meetings specific to the permitting needs of the cannabis industry. Two different tiers of meetings will be offered, depending on the type of cannabis business being proposed. These meetings will be scheduled on a first come, first served basis.

New Service Announcement for Cannabis Industry

Starting in June, the Bureau of Development (BDS) will offer reserved weekly meetings specific to the permitting needs of the cannabis industry. Two different tiers of meetings will be offered, depending on the type of cannabis business being proposed. These meetings will be scheduled on a first come, first served basis. Information gathered at these meetings will assist the applicant in developing appropriate and complete submittal documents for their project, which should help streamline the permitting process.  
 
The Tier 1 meetings will be scheduled for simpler projects, and two meetings have been reserved for Monday afternoons starting June 26th. Typically, “retail only” shops can receive the information they need through this Tier 1 Preliminary Life Safety meeting. BDS and the Fire Bureau will provide consistent staff at these meetings (Life Safety Plans Examiner, Mechanical Engineer, Fire Plans Examiner).  In addition, a City Planner will attend these meetings to provide zoning information. The fee for the meeting is $511. If requested, a structural engineer can also attend the meeting for an additional $152 fee.  Staff require a minimum of 5 business days to review the materials prior to the meeting. The Tier 2 meetings are for larger, more complex cannabis businesses such as production (growing), processing (extraction), wholesale operations, or some combination of these business types. BDS will offer reserved consecutive Early Assistance (EA) and Preliminary Life Safety Meetings on Thursday mornings beginning June 29th. The Early Assistance – Zoning and Infrastructure meeting will allow the applicant to meet staff and receive information related to the zoning code, as well as the infrastructure bureaus (Water Bureau, Bureau of Environmental Services, Portland Bureau of Transportation and Parks Bureau). The Preliminary Life Safety meeting will be offered in conjunction, and will provide consistent staff including a Life Safety Plans Examiner, a Mechanical Engineer, and a Fire Plans Examiner. Offering back to back Early Assistance meetings and Preliminary Life Safety meetings should provide these larger, more complex projects with a full picture of the requirements related to their proposal. These larger projects may trigger significant improvements beyond the building footprint itself, and these can be identified earlier through the EA meeting rather than at the building permit stage, when large budget items can severely impact project viability.  To schedule a Tier 2 meeting, businesses must submit both the Early Assistance - Zoning and Infrastructure application and the Preliminary Life Safety Meeting application. When submitting the information and scheduling the package of consecutive meetings, please be aware that staff require a minimum of 10 business days to review the materials prior to the meeting date. The meetings will be scheduled first come first served, based on availability.   

There are two information packets that need to be submitted to schedule the two meetings. The Life Safety Preliminary Meeting Packet should be submitted first and will be reviewed for completeness.  Please contact Cassandra Scholte at cassandra.scholte@portlandoregon.gov or 503-823-6856 to schedule an appointment to submit the Life Safety Meeting Request materials. The Early Assistance application will be submitted in person in the Development Services Center. The fees will be paid for both meetings, and the meeting can be scheduled at that time. 

The fees for the consecutive meetings are: 
Preliminary Life Safety meeting is $511. If requested, a structural engineer can also attend the meeting for an additional $152 fee.    
Early Assistance - Zoning and Infrastructure meeting is an additional $2,074. Please note these fees will increase at the beginning of the fiscal year on July 1st.

Batch Permit Submittal and Review Process

Effective May 1, 2017 -  Projects with three or more detached dwelling units (designed to the residential code) on a single lot, or three or more dwelling units that are attached to one another, are submitted through the Batch Submittal and Review Process. Examples of Batch Track Projects could include three townhouse units, or three or more single-family homes on one tax lot. These projects necessitate Batch Track processing due to unique Planning and Zoning requirements, which differ from those for standard single-family development. In addition, projects involving multiple structures on one lot require a separate Site Development permit for the common infrastructure elements such as driveways, utilities, bicycle and pedestrian amenities and landscaping. 
 
To improve the efficiency of the intake process and the permit review process, the Batch Permit intake process will incorporate the following change as of May 1, 2017. The initial Life Safety intake review will determine whether the documents provided meet minimum intake requirements. If the intake requirements are not met, a deficiency report will be generated and sent to the applicant identifying the missing required information. At any time the applicant may schedule a Life Safety Preliminary Meeting to assist with the intake process. If the submittal requirements are not met with the 3rd attempt to provide the minimum required information, the applicant will be required to schedule and attend a Life Safety Preliminary Meeting as part of the next intake attempt.

Residential Permit Night Returns to the City’s Development Services Center

As part of an ongoing effort to increase accessibility, the Bureau of Development Services (BDS) will host a Residential Permit Night for 1 & 2 Family Dwellings in the Development Services Center (DSC). Beginning April 6, 2017, the DSC will be open on Thursday nights from 5:00 p.m. – 7:30 p.m. to help homeowners and tenants with their residential 1 & 2 family dwelling projects. The DSC is located at 1900 SW 4th Ave at Harrison Street on the first floor.

City staff will be available to answer general questions about the permitting and land use processes, help homeowners and tenants understand what plans and documents will be required for review, and identify the necessary permits and inspections for a successful project.

“Traditionally, regular business hours make it somewhat difficult for working people and their families to get to the City for permits,” said Commissioner Chloe Eudaly, who is in charge of BDS. “These new hours will make things more accessible to the larger community.” BDS Director Paul Scarlett added, “The City is excited to restart this important program after it was put on hold in January 2009 as a result of the recession.”

Residential Permit Night is focused on helping homeowners and tenants, whether they are planning simple “Do-It-Yourself” projects, or major renovations or additions. Homeowners and tenants can research residential permit records at the Resource Records counter and get residential plumbing, electrical and mechanical permits at the Trade Permits counter. When residential building permit plans and documents are ready to submit, they can get the process started with the goal of issuing a permit, when possible. New single family and detached Accessory Dwelling Unit (ADU) permits will need to be submitted during regular business hours, due to the additional staffing requirements for those projects.

Note: Staff who can assist with transportation, sewer/stormwater, and water requirements related to residential permits will only be available the first and third Thursdays of each month.

Residential Permit night is dedicated to homeowners and tenants with questions and applications for residential 1 & 2 Family Dwelling permits only; assistance with commercial projects will not be available. Permits can only be issued to the homeowner or with the homeowner’s permission.

Beginning March 31, 2017 Violations of City Short Term Rental Requirements will be Issued Citations

The adopted Administrative Rule provides BDS the authority to issue citations for violations of the Portland Zoning Code ASTR regulations.

Beginning March 31, 2017 Violations of City Short Term Rental
Requirements will be Issued Citations

On February 9, 2017, the Bureau of Development Services (BDS) adopted an Administrative Rule for the enforcement of Accessory Short Term Rentals (ASTR) in the City of Portland. The adopted Administrative Rule provides BDS the authority to issue citations for violations of the Portland Zoning Code ASTR regulations. On March 31, 2017, BDS will begin issuing citations for ASTR violations in order to allow for communication of the new enforcement approach to interested parties. Violations of the ASTR regulations will be issued citations ranging from $1,000-$5,000 per occurrence. Citations are effective immediately and do not provide a compliance period prior to the assessment of fines. The citation can be reviewed administratively and then appealed to the Code Hearings Officer.

“I am very pleased BDS is increasing enforcement options for Accessory Short Term Rental violations within the City,” said City Commissioner Chloe Eudaly, who has responsibility for BDS. “I have been very concerned about illegal full time commercial short term rentals in residential zones and I believe the new citation authority will assist BDS in responding to these egregious violations and improving compliance rates.”

In August 2014, the City of Portland adopted amendments to the Portland Zoning Code to allow Accessory Short Term Rental (ASTR) operations in residences. These rules were focused on a permitting process for applicants that ensured guests were safe during their stay, and included limitations on the operations of the rental in an effort to ensure that properties continue to retain a primarily long-term residential use. BDS has received increased complaints regarding properties operating without the legally required ASTR permit, as well as complaints regarding properties with issued ASTR permits. Complaints include allegations that some ASTR operations are renting out more bedrooms than allowed by permit, allowing more than 5 overnight guests, or operating the business without a primary long-term resident at the property. BDS is also receiving complaints of short-term rental that are resuming illegal operations after a BDS enforcement case has been closed.
 
On December 16, 2016, a public hearing regarding the Administrative Rule was held. It was attended by more than 40 members of the public. In addition, BDS received 189 written comments regarding the proposed Administrative Rule with an overwhelming majority of comments- 78 percent -supporting the proposed rule.
 
“I am confident that the Administrative Rule provides an enforcement approach that is necessary to ensure that compliance with the ASTR permit requirements are met, which establish minimum safety standards for overnight guests as well as protects livability by limiting the amount of commercial activity in our neighborhoods,” said BDS Director Paul L. Scarlett.
 
BDS will be working closely with various online platforms that facilitate short term rental hosting in order to best reach short term rental operators in the City of Portland. Additionally, BDS will be sending notification to ASTR permit holders as well as operators that have ASTR permit applications on file that have not been approved due to an incomplete application submittal.
