Proposed 2019 Code and Rule Errors and Omissions Package

The Bureau of Environmental Services (BES) requested comments from the public on its proposed 2019 Code and Rule Errors and Omissions Package from 8 a.m. Wednesday, Jan. 16, 2019 through 5 p.m. Tuesday Feb. 19, 2019. The comment period is now closed. 

BES proposes minor modifications to 13 sections of the Portland City Code (PCC) and 12 Administrative Rules. The 2019 Errors and Omissions Package will make the following changes:

  • Correct typographical and formatting errors.
  • Remove an expired provision in code.
  • Correct errors and omissions as a result of separating the Source Control Manual (SCM) from the Stormwater Management Manual (SWMM) in 2016.
  • Clarify unclear, inconsistent, duplicative, or ambiguous language and graphics.

The most significant changes are summarized below:

CURRENT REGULATIONS PROPOSED CHANGE
Prior to 2016, source control requirements were in the SWMM. Some sections of Code and some Rules only reference the SWMM. References to the SCM are added.
The Code currently uses the terms “sewer laterals,” “sewer service laterals,” and “laterals” to mean the same thing in PCC 17.32. Only the defined term “laterals” will be used.
There is a reference to a “billing error” in PCC 17.36, but no definition is provided. A definition of “billing error” is being added.
The explanation of Sanitary Line Charges in PCC 17.36 is unclear. New language clarifies the original intent.
Infiltration testing requirements for land divisions in ENB 4.01 is unclear. New language provides clarity of the original intent.
A table of Fixture Types and Equivalency Factors is copied into ENB 4.05 from State regulations. The table is removed from the Rule so that changes to State regulations do not make the Rule obsolete.
The SCM (ENB 4.34) does not contain Operations and Maintenance Submittal Requirements due to an error from 2016, when the SWMM and SCM were separated. The requirements are reinserted into the appropriate place in the SCM.
