Upon written request from a building owner, the Bureau of Planning and Sustainability (BPS) may exempt a covered building for a specific year based on one or more of the following conditions:
- The building is new construction and energy service has not yet been established for a full calendar year;
- The building was wholly unoccupied during the entire calendar year for which reporting would otherwise be required;
- A demolition permit was issued for the building during the calendar year for which reporting would be required; or
- Due to a special circumstance unique to the building, compliance would cause undue hardship for the owner.
Within 30 days of receiving the exemption request, BPS will provide a written response to acknowledge receipt of the request and determine whether the request is approved or denied.
