FINAL ADMINISTRATIVE RULES FOR PORTLAND CITY CODE CHAPTER 17.108 – HOME ENERGY PERFORMANCE RATING AND DISCLOSURE

Portland City Council unanimously adopted the Home Energy Score Ordinance, Portland City Code Chapter 17.108, on December 14, 2016. The policy went into effect on January 1, 2018. In preparation for the effective date, the Director of the Bureau of Planning and Sustainability adopted administrative rules on December 18, 2017 that addressed the requirements of the Home Energy Performance Report for home sellers, compliance and enforcement and confidentiality, in coordination with the code.

The amendments to these rules further clarify requirements for Home Performance Scores and Reports, home sellers, new homebuilders and Home Energy Assessors. Public review and comments were accepted between November 12 and November 26, 2018 and a public hearing was held on November 26, 2018. Questions were answered, and clarifications made but no substantive change to the amended rules occurred subsequent to public review.

The amended Final Administrative Rules (posted below) are in effect as of December 18, 2018.
