NO SMOKING IN PIONEER COURTHOUSE SQUARE TRANSIT AREAS

No person shall smoke in any part of the areas of
Pioneer Courthouse Square designated exclusively for transit use. For purposes of this Rule, the areas of Pioneer Courthouse Square designated exclusively for transit use are those so established in the Rule issued by the Commissioner of Parks on June 12, 2002, and filed in the Portland Policy Documents as PRK – 1.01.
Second-hand smoke has been identified as a substantial public health hazard. While, generally, people present in the outdoor areas of parks have the opportunity to avoid exposure to second-hand smoke by moving away from smokers, people waiting for MAX trains at the platforms in Pioneer Courthouse Square need to be in those areas in order to board the trains. Tri-Met has prohibited smoking at its other shelters and platforms, but Tri-Met does not regulate the train platforms in
Pioneer Courthouse Square. To promote consistency with Tri-Met’s policies and to promote the public health, it is advisable to ban smoking in those areas of Pioneer Courthouse Square that are designated exclusively for transit use.
