INSURANCE REQUIREMENTS FOR PERMITS IN THE PUBLIC RIGHT-OF-WAY

INSURANCE REQUIREMENTS

I.  Purpose

City of Portland right-of-way permits require the permittee to name the City as an additional insured. Prior to issuance of certain permits, the insurance certificate and endorsement will be reviewed by the city attorney’s office.

II.  Administrative Rules

A.  The City of Portland requires:

1.  A Standard Certificate of Liability Insurance, with the City of Portland, 1120 SW 5th Avenue, Suite 825, Portland, OR 97204 named as the Certificate Holder, and

2.  An endorsement naming the City of Portland as an additional insured. The following types of endorsements are acceptable: A CG 2012 or BP 04 52 form (standard insurance industry forms referencing State or Political Subdivisions and Permits) (or equivalent as approved by the Office of the City Attorney). Fill in the Policy Number on the additional insured form. In the schedule section of the CG 2012 within the “State or Political Subdivision” box, type the name “City of Portland.”

B.  Minimum Requirements for Liability Insurance

Minimum requirements are set at the discretion of the Bureau Director, and are published in the City of Portland Fee Schedule.

C.  Purpose of Permit

In the description of operations section of the certificate, indicate a specific activity and location (such as sidewalk café or tree trimming) or state “all operations” to cover multiple activities and locations. City of Portland should be listed as an additional insured in this section and the additional insured endorsement form should be referenced.

D.  Cancellation Notification

The City of Portland requires thirty (30) days’ written notice from the insurance company prior to terminating or canceling the policy

E.  Regulations

The insurance certificate and the endorsement will be reviewed by the city attorney prior to permit issuance for permits requiring insurance.

Approved insurance documents will be stored electronically for two years from the certificate’s date of expiration.
