EXEMPTION FOR SKYSTRUCTURES - ASSISTED LIVING & RETIREMENT CENTERS OUTSIDE OF CENTRAL CITY DISTRICT
Binding City Policy
Section 1. The Council finds:
1. Whereas Portland City Code Chapter 17.44 regulates Street Obstructions by Ordinance No. 184957 adopted by Portland City Council effective November 25, 2011.
2. Chapter 17.44.010 states that it is unlawful for any person to erect or cause to be erected any structure in, over or upon any dedicated street area, except that Director of the Bureau of Transportation may, based on findings of necessity, grant permission for walls, fences and steps, that otherwise comply with the Code of the City.
3. Whereas the exclusion of skybridges by this chapter is designed to keep pedestrian traffic at street level and skybridges are still discouraged.
4. An assisted living facility has requested to build a skystructure to serve its residents.
NOW, THEREFORE, the Council directs:
a. Outside of the Central City District, Type I Skystructures serving Assisted Living & Retirement Centers are exempt from the following polices found in Chapter 17.44 Street Obstructions: City Code 17.44.010, as it pertains to unlawful acts enumerated in section B.
b. This ordinance supersedes TRN-8.01 (Major Encroachments in the Public Right-of-Way) as it relates to Type I Skystructures serving Assisted Living & Retirement Centers outside of the Central City District.
c. This ordinance is binding City policy.
