ADU Exemptions for Relocation Assistance Expanded
Effective November 1, 2019, landlords that live in an Accessory Dwelling Unit (ADU) on the same property as their tenants can be exempt from Portland’s Mandatory Relocation Assistance payments. This change in City code allows landlords with ADUs more flexibility when deciding which unit to live in and which unit to rent out. Landlords claiming this exemption are required to provide their tenants with an Acknowledgement Letter from the Rental Service’s Office. All existing tenancies are currently eligible, however, forthcoming changes to the Administrative Rules will soon require the Acknowledgment Letter to be provided before entering into a new rental agreement. If you live in an ADU on the same property as your tenants, this office encourages you to file as soon as possible. As with all exemptions, certain stipulations apply. Visit www.portlandoregon.gov/phb/rso for more information or call the Rental Services Office at 503-823-1303.
