February Hit and Run Victim Dies - Driver May Face Additional Charges (Photo)

On February 6, 2014, at 12:40 a.m., East Precinct officers responded to Southeast 128th Avenue and Division Street on the report that a man in a wheelchair had been struck by a car, which fled the area. The victim was crossing Division in a marked crosswalk at the time of the crash.

Officers arrived in the area and located the victim, 60-year-old Gary Horner, suffering from serious injuries that, at the time, did not appear to be life-threatening.

Officers canvassing the area located the suspect vehicle, a 2001 Chrysler sedan, at Southeast 148th Avenue and Division Street and arrested the driver, 20-year-old Rodney Japheth Benjamin Larry, for Driving Under the Influence of Intoxicants (DUII), Reckless Driving and Failure to Perform the Duties of a Driver (Hit & Run).

Horner was transported to a Portland hospital for treatment but ultimately died on March 12.

Traffic investigators are continuing to investigate the circumstances of the crash. When the investigation is complete, officers will present the case to the Multnomah County District Attorney's Office for consideration of additional charges as a result of Horner's death.
