This project streamlines the regulations for development of affordable housing on Conditional Use sites. New regulations include these amendments to the regulations in 33.815, Conditional Uses, and 33.820, Conditional Use Master Plans:

Exemption from Conditional Use review for:

• Development of affordable housing.
• Repurposing up to 50 percent of parking areas on Conditional Use sites for affordable housing.
• Increases of up to 2,000 square-feet of new floor area.
• Reducing the site boundary.
• Maximum of Type II review when Conditional Use review is required, for development of affordable housing.
• Type II review for some alterations to an existing conditional use.

Changes in chapters 33.281, Schools and School Sites and 33.667, Property Line Adjustment:

• 33.281, Schools and School Sites: exemption from Conditional Use review for increases of up to 2,000 square-feet of new floor area; Type II review for changes of up to 25 percent of existing floor area.
• 33.667, Property Line Adjustment: exemption from lot size and lot line length regulations on Conditional Use sites.

A series of unrelated typos is also corrected herein.

Substantive Changes:  

The Central City 2035 Plan (CC2035) was adopted by Portland City Council on June 6, 2018, with an effective date of July 9, 2018. It was then appealed to the Land Use Board of Appeals and the Court of Appeals. On March 16, 2020, CC2035 was remanded to the City of Portland. The remand requires the City of Portland to readopt CC2035 with amendments. Until the plan is readopted, the code provisions in effect before the 2018 CC2035 Plan adoption once again apply. This remand affects the Central City Plan District and chapters that apply to the Willamette River and citywide. The City anticipates readoption of CC2035 in April 2020 with a new effective date in mid-May 2020.

Substantive Changes:      
This packet includes three major code change groupings and also fixes a few typos.

Better Housing by Design: Includes substantial updates to Chapter 33.120 (Multi-Dwelling Zones). Major changes include a shift from regulating by maximum unit density to instead regulating by building scale (FAR) with more flexibility for numbers of units, new names for the multi-dwelling zones, new development bonuses for affordable housing, limitations on front garages, expanded requirements for outdoor spaces in higher-density zones, and development standards specific to East Portland (mostly east of 82^nd Avenue). The amendments also include some revisions to Chapter 33.130 (Commercial Zones) and other zoning code chapters to provide consistency with the multi-dwelling zone amendments.

Bike Parking: Updates the Bicycle Parking requirements in the Zoning Code (33.266.200) to ensure new development and major redevelopment provides adequate, secure and convenient short- and long-term bicycle parking. Elements include: enhance security standards to help prevent bike theft; increase options for space saving racks; usability for a variety of types of bicycles and people of all abilities; update the minimum required amounts of short- and long-term bicycle parking; expand the use of geographic tiers to all Use Categories; and reduce the in-unit allowance for required long-term bicycle parking. 

Annual Dollar Thresholds Update: March 1 update to dollar thresholds based on the annual national average of the Construction Cost Index (CCI), as published in the second January issue of the Engineering News-Record.
