Proposed Design | Portions of the storm water and sanitary sewer systems that will serve the Parcels will cross property lines of various Parcels. A sewage treatment system (Living Machine) and storm water management system crossing multiple property lines of a super block consisting of four blocks plus private streets. |
Reason for alternative | The systems are designed specifically to accommodate the four block complex and required interconnectivity. These systems are intended to help reduce the loading placed on the public systems and provide efficient on site systems. A “Covenant for the future easement and maintenance agreement effective on date of sale” is in process of being completed restricting the sale of properties. |
Appeal Decision
Sewage treatment and stormwater management system serving multiple tax parcels: Granted provided Living Machine is installed and operational as proposed.
Note: If Living Machine is not installed or is subsequently decommissioned, then each of the lots must have their own connection to the public sanitary sewer and that connection must be adequately sized to accommodate that entire lot. Storm lines as shown are approved contingent upon language in the recorded covenant.
Draft of the covenant is required to be reviewed and approved by BDS prior to recording. Recording of covenant is required to be completed prior to issuance of the main building permit. Appellant may contact Nancy Thorington (503-823-7023) for more information.
The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
