Appeal Information Sheet

Appeal item 1

Code Section

R311.7.2

Requires

6' 8" headroom for new stair required

Code Modification or Alternate Requested
Proposed Design

6' - 5" @ foot of stair proposed.

Reason for alternative

Existing joist @ floor edge cannot be moved back. Owner is comfortable with proposed clearance. Height is compromised because of deeper width stairs being proposed.

Appeal item 2

Code Section

R311.7.1

Requires

36" wide stairwell above handrail.

Code Modification or Alternate Requested
Proposed Design

Existing stair is 32" wide. The treads are 7" deep. We propose 9" treads with 7 1/2" risers in a replacement stair.

Reason for alternative

Walls are existing and house is narrow. Existing stairs are dangerous. New stairs will be safe. 32" is generous for a basement stair. Existing stairs are allowed to be 30" wide.

Appeal Decision

1. Reduced headroom of 6'-5" at reconstructed staircase to basement: Granted as proposed.

2. 32" width at reconstructed staircase to basement: Granted as proposed.

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
