Appeal Information Sheet
Appeal item 1
Code Section | Oregon Plumbing Specialty Code 1101.5.3.2 |
---|---|
Requires | No dry well shall be located closer than 5 feet (1524mm) of a property line nor closer than 10 feet (3048mm) to a building unless approved by the building official. Appeal of plumbing code setback requirements to provide on-site infiltration of stormwater and handle the design storm of 3.4 inches in 24 hours, a 10-year design storm requirement. |
Code Modification or Alternate Requested | |
Proposed Design | See design plans. Providing an infiltration trench--10 feet deep x 2 feet wide exceeding the requirements for infiltration of a 10-year design storm. Overflow provided which meets all requirements of the plumbing code for drainage into public storm sewer/sanitary sewer facility in the street. We are meeting or exceeding Section 1.3.1, 1.3.2, 1.3.3 requirements of the Storm Water Management Manual, simplified approach. See attached report and drawings showing the design meeting those requirements. |
Reason for alternative | This alternative (proposed design) is required to fit the stormwater treatment facility on site. The other alternative is to pipe all stormwater thru the public combined sewer in the street, a far less acceptable method of handling stormwater. |
Appeal Decision
Reduction in Setback of Storm Water Detention Trench from Property Line and Building: Denied. Proposal does not demonstrate how the trench can be constructed without endangering the adjacent property or the proposed structure.
