Appeal Information Sheet
Appeal item 1
Code Section | 210.52 (D) and 406.9(C) |
---|---|
Requires | 210.52 (D) Bathrooms. In dwelling units, at least one receptacle outlet shall be installed in bathrooms within 900 mm (3 feet) of the outside edge of each basin. The receptacle outlet shall be located on a wall or partition that is adjacent to the basin or basin countertop, located on the countertop, or installed on the side or face of the basin cabinet. In no case shall the receptacle be located more than 300 mm (12 inches) below the top of the basin. Receptacle outlet assemblies listed for the application shall be permitted to be installed in the countertop. 406.9(C) Bathtub and Shower Space. Receptacles shall not be installed within or directly over a bathtub or shower stall. |
Code Modification or Alternate Requested | |
Proposed Design | To accommodate the two codes in our wet room design, we will be including a shower rod and curtain to bisect the room, therefore separating the shower and the lavatory receptacle outlet. The receptacle outlet that we will use is a weather-protected weather-resistant GFI. The lightswitch for the room will be outside of the room, away from wet space. |
Reason for alternative | This room is designed to be small and efficient as it is in a very small (300sqft footprint) Accessory Dwelling Unit. Omitting a shower stall will also allow the bathroom to remain accessible and compatible with aging in place. The use of a shower curtain and rod will provide adequate safety by keeping the water separate from the receptacle outlet. In addition, the weather-protected weather-resistant GFI will further the level of safety. Keeping the light switch outside of the room will eliminate any further electrical safety hazards. |
Appeal Decision
Electrical outlet in ADU shower room: Granted provided outlet is located outside of shower curtain, is equipped with a listed wet location bubble cover, and the light switch is located outside of the room.
The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
