The project proposes to construct a 70' diameter cul-de-sac as the turnaround at the end of NE Oregon Street, which meets the PBOT requirements for a cul-de-sac turnaround and provides a turnaround even if it's not to fire district standards of 90 feet. All three new houses to be constructed will be fully-equipped with a fire sprinkler system throughout their entirety, including the attic space, garage and closets.

REAPPEAL: The project proposes to construct a 36' diameter cul-de-sac as the turnaround at the end of NE Oregon Street, which meets PBT requirements for a reduced cul-de-sac turnaround and provides a turnaround even if it's not to fire district standards of 90 feet. All three new houses to be constructed will be fully-equipped throughout with a fire sprinkler system throughout their entirety, including attic space, garage, and all closets.

Reason for alternative

Attached exhibits show a 36-foot cul-de-sac turnaround which PBOT allows as the minimum cul-desac, the proposed 70-foot cul-de-sac and the Fire standard 90-foot cul-de-sac. As the exhibits show, the 36-foot cul-de-sac is hardly more than what is currently present and doesn't really provide much of a turnaround. The 90-foot cul-de-sac is so large that it reduces Parcels 2 and 3 to such a small size and width that there isn't a lot of space left for a house and a yard when setbacks and driveways are taken into consideration. The proposed 70-foot cul-de-sac meets the PBOT requirement for a turnaround, still provides a larger turnaround than the 36-foot cul-de-sac and certainly provides a turnaround for an existing street that currently services an established development with no turnaround at all. The proposed alternate, therefore, adds to the existing conditions by providing a turnaround that isn't already there, as well as providing full fire sprinkler systems in the three new houses to be constructed. It should be noted the existing house on this existing parcel does not have a fire sprinkler system or a turnaround. This house will be demolished and, with this proposal, will be replaced with a fully sprinkled dwelling that has a 70-foot cul-de-sac turnaround, so the end result of this alternate is beneficial to the existing situation as well.

REAPPEAL: Attached exhibits show a 36-foot cul-de-sac turnaround which PBOT allows and has approved as tbe minimum cul­de-sac and the Fire standard 90-foot cul-de-sac. Even though the 36-foot cul-de-sac does not provide much of a turnaround, it is more than what is presently in use - which is no turnaround at all. As stated PBOT has approved the reduction to the 36-foot cul-de-sac. Appeal ID #16341 Case #18-02 approved a reduction to a 70-foot cul-de-sac. However, in doing the final lot layout design and tree preservation plan, all the trees along NE Oregon Street, as well as two off-site trees were going to be destroyed with construction of the 70-foot cul-de-sac. Additionally, Parcel 2 was unable to meet the lot width requirement at the new front setback with the 70-foot cul-de-sac and the house footprint on Parcel 3, to preserve the tree in the southeast comer, needed to be adjusted to an undesirable and non-marketable shape and size. Since the previously-approved reduction from 90 to 70 didn't meet fire turnaround standards anyway, the further reduction does not worsen the situation. Either the cul-de-sac meets standards or it doesn't. The proposed alternative provides a turnaround for vehicles and trucks, though, that isn't presently existing and will provide complete fire sprinkler systems throughout the three new houses. It should be noted there is an existing house at tbis deadend street, that presently doesn't have any type of turnaround and no fire sprinkler system. The proposed alternative allows the project to go forward which will entail demolishment of the existing house and replacement with three new houses that will be built to current fire code standards and fully sprinkled throughout their entirety, as well as providing a turnaround tbat doesn't presently exist.

Appeal Decision

Please note:
• The Portland Fire Marshal has determined that the NE Oregon Street does not meet the minimum fire department access road requirements.

• Based on that determination, the Building Official, in consultation with the Portland Fire Marshal on February 16, 2018, herby notifies the applicant that the Building Official intends to allow a NFPA 13D automatic sprinkler system in lieu of meeting the fire department access road requirements.
