Request that the permit for temporary shoring be extended from 180 days to 3 years with regular inspections.

Proposed Design

Existing concrete sidewalk support was found to be damaged after years of water intrusion. The permit is to add temporary shoring constructed of wood framing to support the traffic loading and damaged concrete above. Existing shoring was found to be insufficient and unpermitted, so this permit seeks to bring the temporary fix up to code. Per conversations with the inspector (Jeff Gauba), a series of regular inspections will be provided over the duration of the temporary shoring life.

Reason for alternative

The owner of the property, Innovative Housing Inc., requires more than the code maximum 180 days to gather the funding to design and install a code-compliant, permanent repair of the damaged concrete. The structural design of the temporary shoring included in the permit is per code and has passed plan check review for all items except the 180 day duration requirement. The permitted temporary shoring would provide adequate support for the damaged concrete sections as shown in the permit calculation package. Further, inspections will be scheduled at intervals not exceeding 180 days to ensure the adequate performance of the shoring.

Appeal Decision

Extension of temporary shoring permit from 180 days to 3 years: Granted provided permanent construction is completed within 3 years of the date of permit issuance with the Dangerous Building case fee waiver contingent upon reinspection at maximum intervals of 6 month and provided a separate inspection is performed by the engineer of record in the event the integrity of the shoring is suspected.

The Administrative Appeal Board finds with the conditions noted, that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
