Requires

The requirement of the code is that 10' of easement area for sanitary lines.

Code Modification or Alternate Requested

We are requesting an appeal to the code so that our 6' wide easement would be allowed instead of the standard 10' dimension.

Proposed Design

The sanitary line will be installed in such a way to allow for the buildings to be closer together and fit the cottage cluster code.

Reason for alternative

We would not be able to fit the 10' easement with the desired layout for the cottage cluster development on this site.

Appeal Decision

Allow 6' easement with traditional trenching: Granted provided sewer and storm piping are as shallow as possible. The trenching shall not undermine footings of adjacent structures.

"The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
