Appeal Information Sheet
Appeal item 1
| Code Section | R312.1.3 |
|---|---|
| Requires | Guards shall not permit the passage of a sphere greater than 4" in diameter |
| Code Modification or Alternate Requested | We are proposing to make minor modifications to an existing guard, which includes an opening of 5.5" near the top of the guard (the rest of the guard below this opening is a solid wall). We would like to make a few minor changes to the structural attachments of said guard, and we ask permission to keep the existing geometries in place, which include a 5.5" gap near the top of the guard/wall. |
| Proposed Design | A dimensioned cross section of the existing (same as proposed guard/wall is included in the attached drawings. |
| Reason for alternative | We are proposing minor structural attachment changes (described in the attached drawings), in the context of repairing the non-structural wood components of the existing guard wall. We would like to keep the existing geometries as-is, for aesthetic reasons as well as cost-control reasons. We will not make the new guard any less conforming than the existing guard. All proposed structural changes will be engineered by a licensed structural engineer, and we will obtain a building permit for the proposed changes. |
Appeal Decision
Request to increase guardrail opening limitations: Granted as proposed.
"The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
