Appeal Information Sheet
Appeal item 1
| Code Section | UBC Chapter 13 |
|---|---|
| Requires | 1970 Edition of UBC Chapter 13 agreement [Amanda / TRACXS # 00-180265 SY] from 30 July 1973 and Chapter 13 Appendix; see exhibit A & B. |
| Code Modification or Alternate Requested | This is a Chapter 13 building appeal for permission to proceed with the proposed scope of work; see plans - exhibit C. |
| Proposed Design | Revise the ground floor plan of the previous rehabilitation facility to suit better the function of the outpatient clinic tenant [Oregon Change Clinic]. |
| Reason for alternative | There are no alternates or modifications planned to the noted requirements of Chapter 13 Appendix. All portions of the current design meet current code. This is an appeal of Chapter 13 on an existing building from the 1970 UBC. The proposed design removes interior accessibility barriers to better serve the community in the existing building use as an outpatient rehabilitation clinic. The building is fully sprinkler per NFPA 13 and all new work will continue that coverage. All existing egress routes are maintained providing life safety compliance within the 2022 OSCC. Per coordination with Fire Inspector Specialist Joe Thornton an appeal is required for any work on a Chapter 13 building that modifies: the life safety systems, means of egress systems, or anything item of the Chapter 13 agreement. |
Appeal Decision
Permission to proceed with the proposed scope of work on a Chapter 13 building: Granted provided building permit reviews are completed.
The Administrative Appeal Board finds with the conditions noted, that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
