Appeal Information Sheet

Appeal item 1

Code Section

1011.5.2 and 1011.6

Requires

Max. 7" riser and min. 11" tread and landing same length as stair is wide.

Code Modification or Alternate Requested

Treads 1" less than commercial code and landing less than stair width

Proposed Design

This stair is serving two 'basement' apartments. Grades did not allow a longer stair. We are close in Rise and Run but treads are about 1" short of commercial 7-11 code.

And - the stair width is only required to be 36" - we made it 48" - but we don't have the room to increase the landing width - it is proposed at 38".

Reason for alternative

We are very close to commercial code for a stair/entry that serves two apartments. Existing conditions did not allow for a longer stair. If helpful - we could reverse the swing of the door to 'out' so the landing isn't impinged upon.

Appeal Decision

"1a) Allow rebuilt stair treads with 10"" depth: Granted as proposed.
1b) Allow rebuilt stair landing with 38"" depth: Granted provided the door to exterior is reversed to swing out.

"The Administrative Appeal Board finds with the conditions noted, that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
