Appeal Information Sheet
Appeal item 1
| Code Section | table R302.1 - Exterior walls |
|---|---|
| Requires | Exterior walls shall be of one hour rated construction within 3' of a property line |
| Code Modification or Alternate Requested | We want to build an ADU 2'-2"+/- away from the existing garage. To do so both the garage AND ADU wall need to be 1 hour rated with no eaves, etc. |
| Proposed Design | This appeal is for the ADU (being permitted separately from the garage 1 hr wall) to allow (2) 5/8" type 'x' to installed at the inside face of the wall as well as the inside face of the roof rim joist - there is no eave and the building is slab on grade. This will allow us to provide fire protection similar to the garage and have the siding smooth where the gyp. sheating would not be needed. |
| Reason for alternative | With both the garage and ADU having modified 1 hour walls - we feel each structure is protected from the adjacent structure. |
Appeal Decision
Request modified version of 1-hour fire-resistance rated walls: Granted as proposed.
"The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
