Appeal Information Sheet

Appeal item 1

Code Section

710.1

Requires

backwater valve to be installed on fixtures that are below the nearest upstream manhole of the city sewer

Code Modification or Alternate Requested

They would like the new backwater valve to be accepted and approved because they had one installed previously & they have experienced backups they are wary of damage to their home.

Proposed Design

Backwater device on building drain in basement

Reason for alternative

The homeowner had a previously installed whole home backwater valve on the building drain in the basement.  They informed us that it had been approved by the city, but we were unable to confirm this.   They have had previous backups in the past, and are wary of not having this protection moving forward, which is why we installed the backwater valve on their system.  They would like the new backwater valve to be accepted and approved.

Appeal Decision

OPSC 710.1 Backwater valve installed serving whole house: Granted as proposed.

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
