| Reason for alternative | This alternate is required to maintain the structural integrity of the sidewalk in the ROW along NW Naito Parkway, as the building's south side foundation and basement wall extend below the ROW's zone of influence. Additionally, the building's north side foundation is integral with a sea wall which forms the top of bank along an inlet of the Willamette River. As this is an Appeal to a demolition permit on an unoccupied lot, there will be no loss of health, accessibility, structural capacity, energy conservation, or fire protection. Further, there is an improvement to life safety, as the existing building has been deemed unsafe for occupation. |

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
