Removal of original appeal in full. Conditions for appeal no longer apply as the space has been revised since the original installation.

Removal of non-required smoke detection throughout. Required detection to remain for recall and code minimum detection.

Proposed Design

The existing appeal was based on the 1st floor being two separate tenants (north & South) see attached drawing on original appeal.
This blocked tenant path of egress to exits between tenant's spaces. This has since been modified and is now one tenant space open to all 5 exits (see attached new layout).

Reason for alternative

The condition for the original appeal no longer exists. Smoke detection was noted as being installed throughout the building as part of the appeal and not necessarily installed as a requirement.

We would like to remove the appeal in full as the condition no longer applies and proved a fire alarm panel upgrade with code minimum detection throughout.

Appeal Decision

Remove prior appeal (B-8, 2/10/99), and non-required smoke detection throughout: Granted as proposed.

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
