We are appealing the decision that we are responsible for compensatory excavation requirements of Title 24.50.060.

A freeze impacted a sprinkler system causing water flooding on the property. An emergency repair was required which necessitated immediate work with a request for a permit after work was completed (as advised). This was for neither a new development nor a new building.
A permit was subsequently obtained after the repair, however the laws had changed between when the work was done and when the permit was requested.
We are requesting a one-time waiver of the compensatory excavation requirement.
