This portion of the code would not be applicable because we already have a 1 hr rated parapet wall on the existing adjacent building.

the adjacent building that has a parapet over 30" is directly next to our building with no gap between

Reason for alternative

we propose to not add an additional 10" high of parapet to the already existing parapet. See attached documents and letter for further explanation.

the intent of the code is based on a board description of the use. Even though we are a change of use to a higher hazard, we would actually have less occupants then the current occupant load configuration

We are actually decreasing occupant load do to the nature of the business we are proposing to put in the building

Reason for alternative

base the need for seismic upgrades on occupant load, not the broad definition of the use group.

Appeal Decision

"Item 1: Allow use of existing 20 inch parapet: Granted as proposed.
Item 2: Change of occupancy to dog daycare without seismic upgrade: Granted for this use only."
