Requires

Easement width. The easement for a private plumbing line must be at least 10 feet wide. However, the easement may be reduced to 5 feet wide if the line will be installed and can be repaired without conventional open trench excavation within any portion of the easement area that is less than 10 feet wide.

Requesting for the plumbing easement to be reduced from 10' to 5'.

Proposed Design

Appeals for reduced easement width must clearly show that adequate space is provided within the easement for proper access for installation, maintenance and repair of the private plumbing line.
-There is adequate space for the easement to be reduced to 5' instead of 10'. Our contractor has looked at the site and determined that this will not be an issue in installing and accessing this area in the future.

Reason for alternative

The contractor has verified this will work for this site, and we have done this previously in the past with similar sites.

RECONSIDERATION: The board is requesting the following:

  1. Provide exterior elevations to demonstrate the height of encroaching eaves.

This has been provided.

  1. Directional boring method will not be available for repair and maintenance with the currently proposed location of laterals within the easement. Clarify how the plumbing lines will be maintained and repaired within the constricted 5 foot easement.

While the easement width has been reduced from 10 feet to 5 feet, we have carefully evaluated the site constraints and plumbing layout to ensure that maintenance and repair activities can still be conducted effectively without directional boring.

The plumbing lines are designed and installed with sufficient horizontal and vertical clearance to allow standard repair methods such as hand excavation and trenching within the 5-foot easement. This width provides adequate working space for excavation equipment and personnel access to perform necessary repairs or replacements.

  1. Identify the depth of the pipes in relation to the structure's footings. This can be done with notes on the site plan or a section detail.

The pipe depths have been identified that they will not go below the level of the footings. Located on attached plan.

  1. Update proposed piping material to address OPSC 2023, 609.2 Trenches. There will have to be a change made in the sanitary piping used in the easement, from PVC 3034 to a product that is approved for use inside the building, such as PVC schedule 40 or ABS because there are water and sewer pipes in the same trench.

This has been changed to PVC schedule 40.

Appeal Decision

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
