Appeal Information Sheet

Appeal item 1

Code Section

BCG 06-11: Temporary Indoor Shelters (B)

Requires

The code guide requires occupant load to be determined at a ratio of 1 occupant per 35 square feet. With an area of 2,298 sf, the occupant load is limited to to 65 occupants.

Code Modification or Alternate Requested

We request an increase in the allowable occupant load to 78 occupants.

Proposed Design

We would like to install bunk beds on first floor in the shelter to increase capacity at this existing emergency shelter.

Reason for alternative

Given the current housing emergency it is critical to continue operation of existing shelters while the City and County work together to expand affordable housing and capacity of our shelter system.

Appeal Decision

Allow increase in occupant load from 65 to 78: Granted provided no day use of space.

The Administrative Appeal Board finds with the conditions noted, that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
