We request to temporarily utilize a portion of our warehouse to hold dance classes with a Conditional Use Permit from the Fire Bureau instead of a building permit.

Proposed Design

Utilize 2400 sf of open space in warehouse to provide evening dance classes for ages 10-18. The maximum occupant load will never exceed 49. We request to use this alternate space for up to 6 months or until escalation has decreased at the South Waterfront location.

Reason for alternative

The protests at the ICE facility make our school unsafe to bring students and parents at night. There is not time or need for a change of occupancy permit at our warehouse.

Appeal Decision

Temporary use of warehouse for dance classes: Granted until April 15, 2026 provided the occupant load does not exceed 49 occupants. A separate Conditional Use permit from the Fire Marshal’s Office is required.

The Administrative Appeal Board finds that the information submitted by the appellant demonstrates that the approved modifications or alternate methods are consistent with the intent of the code; do not lessen the health, safety, accessibility, life, fire safety or structural requirements; and that special conditions unique to this project make strict application of those code sections impractical.
